1. Acceptance of Terms

By accessing or using Hyprform ("the Service")—including our website and our iOS and Android mobile applications—you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Hyprform is an AI-powered fitness service that generates personalized workout programs based on your preferences, goals, and fitness level. Our service includes:

• AI-generated workout routines
• Personalized exercise recommendations
• Goals conversation and AI-assisted training roadmaps (year plans, phases, and monthly check-ins)
• Workout program downloads
• User account management on web and mobile
• Progress tracking features
• Optional mobile features such as push notifications, coach messaging, and (with your permission) limited health-data recovery guidance
• Trainer/coach profiles and public catalog
• Coach selection and program filtering
• Trainer portal for fitness professionals
• Gym Portal for facilities to upload class programming history and generate Rx, Scaled, and Foundations class weeks

3. User Accounts

Account Types

Hyprform offers two types of accounts:

• Regular User Accounts: For individuals seeking personalized workout programs
• Trainer Accounts: For fitness professionals who want to create public profiles and offer coaching services
• Gym Accounts: For gym owners, head coaches, or programming staff who manage class programming through the Gym Portal

Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• One person may only create one account per account type
• Trainer accounts require accurate professional credentials and information

Account Responsibilities

• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• Provide accurate health and fitness information for safe workout generation
• Trainers must maintain accurate professional profiles and comply with applicable professional standards

4. Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Share, sell, or distribute generated workout programs commercially without permission
• Use automated tools to access the Service (bots, scrapers, etc.)
• Upload malicious content or attempt to harm other users
• Violate any applicable laws or regulations

Our Content

• The Service, including its design, features, and algorithms, is owned by Hyprform
• You may not copy, modify, or create derivative works of our Service
• Our trademarks and logos are protected intellectual property

Generated Workouts

• Workout programs generated for you are for your personal use only
• You may not redistribute or sell generated workout programs
• You may share workouts for non-commercial, personal purposes with proper attribution

User Content

• You retain ownership of content you upload (profiles, preferences, etc.)
• You grant us license to use your content to provide the Service
• You represent that you have rights to any content you upload

Trainer Content and Public Profiles

• Trainers retain ownership of their profile content (photos, bios, documents, programs)
• By activating your trainer card, you grant us a license to display your profile publicly in our catalog
• Trainers grant users permission to select them as a coach and filter programs by their training focus
• AI-generated trainer summaries are created from your provided information and programs
• You may deactivate your trainer card at any time to remove it from public view
• You represent that you have the right to use any photos, documents, or content you upload
• Trainers are responsible for ensuring their public profile content is accurate and complies with applicable professional standards

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Payment Terms

Hyprform accepts payment through Stripe (website and many billing flows) and, on the iOS app, through Apple In-App Purchase for the Hyprform platform subscription. By completing checkout or authorizing a charge, you agree to these Payment Terms and authorize the applicable payment provider to charge you as described below and at checkout.

• Website / browser checkout: Platform subscription and coach fees are processed by Stripe. You may manage those charges through our website or authenticated billing flows linked from the apps.
• iOS App Store In-App Purchase: The Hyprform platform subscription may be offered as an auto-renewable subscription through Apple. Apple processes that payment and charges your Apple ID. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel in Settings → [your name] → Subscriptions (or App Store → Account → Subscriptions) on your Apple device, or via the manage link we show in the app.
• Google Play: Unless we expressly offer in-app purchase through Google Play for a given product, Google Play billing is not used for Hyprform platform or coach fees.
• Coach fees: Coach access fees are billed via Stripe as disclosed in the product, not through Apple In-App Purchase, unless we expressly state otherwise at checkout.

8.1 Hyprform platform subscription

• Continued access to core Hyprform features after any introductory trial is billed as a recurring monthly subscription (currently USD $14.99 per month, subject to change with notice). The price shown in the App Store or at Stripe checkout for your purchase controls for that purchase.
• During an advertised introductory trial, platform access may be free until the trial ends; we will disclose trial length and what happens when it ends before you are charged.
• Platform fees are billed in advance for each billing period. If you cancel, you generally retain access through the end of the period you already paid for, unless we state otherwise at checkout or under Apple’s subscription rules for App Store purchases.

8.2 Coach access fees (paid coaches)

• Some trainers set a monthly coach fee to generate workout programs using their coaching style and likeness through Hyprform’s AI. The price is set by the trainer and shown to you before you pay.
• Coach fees are separate from the Hyprform platform subscription. When billed on the web, you may be billed for both on a single Stripe subscription with one renewal date, or as separate line items, as shown at checkout.
• Unless we state otherwise at checkout, you are not charged a coach fee merely for selecting a coach in the program catalog. For self-serve generation, coach fees are charged when you confirm payment in connection with clicking Generate (or equivalent) for a program that uses that coach, or as otherwise disclosed in the app.
• Coach fees are generally recurring each billing period while the coach line remains on your subscription, not per individual program generated, subject to any usage limits we display in the product.
• If you add a coach in the middle of a billing cycle, Stripe may charge a prorated amount for the remainder of that cycle; future renewals are at the full monthly rates shown for platform and coach.
• Paying a coach fee does not create a personal training, medical, or professional coaching relationship with Hyprform or with the trainer. See Section 12 (Trainer-User Relationships).

8.3 Payment method and receipts

• We do not store your full card number.
• Stripe purchases: Stripe processes payments and provides receipts and invoices according to Stripe’s policies.
• Apple In-App Purchase: Apple processes payment. Apple provides the purchase receipt. We may store App Store transaction or original transaction identifiers so we can unlock and renew your membership—not your full card number.
• You are responsible for keeping your payment method current. Failed payments may suspend access until resolved.

8.4 Cancellation

• Platform subscription (Stripe / web): You may cancel recurring platform billing from your account billing settings or by contacting support@hyprformai.com. Cancellation stops future platform renewals; it does not automatically refund amounts already paid.
• Platform subscription (Apple In-App Purchase): Cancel or manage auto-renew through your Apple ID subscription settings (see Section 8 above), or use Manage in App Store in the Hyprform app when shown. Turning off auto-renew stops future Apple charges; it does not automatically refund the current period.
• Coach fees: Removing a coach link in your profile or deselecting a coach in the generator does not by itself cancel a recurring coach fee on Stripe. To stop future coach charges, cancel the coach subscription line through billing settings (when available) or contact support so we can adjust your subscription.
• Trainer-assigned programs: If you joined through a coach invite and receive programs assigned by your coach, different generation rules may apply; coach fees may still be required before programs go live, as disclosed in the app.

8.5 Refunds, chargebacks, and billing disputes

Except where required by law, all fees are non-refundable once a billing period has begun, and we do not provide credits for partial billing periods you chose not to use. We may make exceptions in our sole discretion as described below. Apple In-App Purchase refunds are handled by Apple under Apple’s policies; request them through Apple (for example, reportaproblem.apple.com) or Apple Support. For Stripe charges, contact us as below.

Platform subscription refunds (Stripe / web)

• If your first paid platform charge (after any free trial) did not meet expectations, contact support@hyprformai.com within 30 days of that charge with your account email, charge date, and a short description of the issue.
• We may troubleshoot account or technical problems first. Approved refunds are typically issued to the original payment method through Stripe.

Platform subscription refunds (Apple In-App Purchase)

• Request refunds from Apple. Hyprform cannot issue App Store refunds directly. You may also email support@hyprformai.com so we can help investigate access issues.

Coach fee refunds

• If a coach fee charge did not meet expectations, contact support@hyprformai.com within 7 days of that charge. Include the trainer’s name, the charge date, and what went wrong (for example: billing error, duplicate charge, or inability to generate a program with that coach after payment).
• We generally do not refund coach fees for dissatisfaction with AI-generated exercise selection alone when generation completed successfully and matched the disclosed coach style, but we review each request.
• Approved coach fee refunds may be full or partial. Refunding a coach fee does not automatically refund the platform subscription for the same period unless we agree otherwise.

Chargebacks and abuse

• Contact us before filing a chargeback so we can investigate. Unwarranted chargebacks may result in account suspension.
• We may refuse future service to accounts that abuse refunds or promotions.

8.6 Price changes

We or trainers may change prices with notice where required. Continued use or renewal after notice constitutes acceptance of new prices for subsequent billing periods. For App Store subscriptions, price changes also follow Apple’s disclosure and consent rules.

9. Service Availability

• We strive to provide reliable service but cannot guarantee 100% uptime
• We may perform maintenance that temporarily interrupts service
• We reserve the right to modify or discontinue features with notice
• Third-party service dependencies (OpenAI, AWS) may affect availability

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Hyprform is not liable for any injuries resulting from exercise programs
• You use the Service at your own risk and discretion
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the Service
• Some jurisdictions do not allow limitation of liability for personal injury

11. Indemnification

You agree to indemnify and hold harmless Hyprform from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload or submit

12. Trainer-Specific Terms

Trainer Release & Authorization

By registering as a trainer (including through our mobile apps), you grant Hyprform permission to use your name, photo, uploaded documents, programs, and training methodology (“your likeness”) to generate personalized workout programs for users of the Platform.

You understand and agree that:

• Your photo, name, bio, and uploaded content may be used to create a trainer profile and card visible in the Platform’s catalog when you activate it
• Your training style, methodology, and programming preferences may be analyzed and used by AI systems to generate workout programs that reflect your coaching approach
• Users may select you as their coach, and programs generated for those users may use your likeness and training style
• Your likeness may be used in marketing materials, trainer cards, and program generation features
• You retain ownership of your original content, but grant Hyprform a license to use it for program generation and display purposes
• You may request removal of your profile and content at any time by deactivating your trainer card or contacting support

You represent that:

• You have the right to grant this permission
• All content you upload is your own or you have permission to use it
• You will not upload copyrighted material without authorization
• You understand that programs generated using your likeness are created by AI and may not perfectly reflect your exact programming style

Trainer Profile Requirements

• Trainers must provide accurate professional information and credentials
• Trainer profiles must comply with applicable fitness industry standards and regulations
• Trainers are responsible for the accuracy of their public profile information
• We reserve the right to review and moderate trainer profiles for quality and compliance

Independent Contractor Status

Trainers use the Platform as independent contractors, not as employees or agents of Hyprform. Trainers are solely responsible for their own taxes, insurance, and compliance with applicable laws. Nothing in these Terms creates an employment, agency, or partnership relationship between you and Hyprform.

Trainer Payments and Stripe

• Athlete payments for your coaching style on Hyprform are processed through Stripe. You set your monthly price in the Trainer Portal; athletes see that price before they authorize payment.
• For self-serve athletes, coach fees are generally charged when the athlete confirms payment in connection with generating a program using your coach profile, as disclosed in the app—not merely when they browse your trainer card.
• You may publish your trainer card and athletes may subscribe before you finish Stripe Connect onboarding. In that case, Hyprform may hold your share of coach fees until Connect onboarding is complete and Stripe allows payouts.
• Complete Stripe Connect onboarding (identity, banking, and where applicable tax information) in the Trainer Portal to receive payouts. Until then, earnings may show as pending transfer in the Trainer Portal.
• Hyprform retains a 20% platform fee on gross coach fees collected from athletes; you receive 80% of each applicable payment, minus Stripe’s processing fees, per Stripe’s and Hyprform’s payout rules.
• Stripe’s payment processing fee (e.g. 2.9% + 30¢ per transaction in the US) is generally deducted from amounts paid out to you, not from Hyprform’s platform fee.
• Refunds and chargebacks: If Hyprform refunds an athlete for a coach fee, we may reverse or offset the corresponding trainer payout (including amounts already transferred). You are responsible for negative balances created by refunds or disputes, subject to Stripe Connect rules.
• Eligibility to receive payments and payout timing are subject to Stripe’s and Hyprform’s policies. We may delay or withhold payouts for fraud review, policy violations, or legal compliance.

Public Profile and Catalog

• Activating your trainer card makes your profile publicly visible in our catalog
• Users may select you as their coach, which filters available programs
• You may deactivate your trainer card at any time to remove it from public view
• Deactivation does not delete your account or uploaded content

AI-Generated Content

• Trainer summaries are AI-generated based on your provided information and programs
• You may request updates or corrections to your AI summary
• AI summaries are for informational purposes and do not constitute professional endorsements

Trainer-User Relationships

• Selecting a trainer as your coach does not create a formal coaching relationship
• Hyprform facilitates program filtering but does not mediate trainer-user relationships
• Any direct coaching arrangements are between trainers and users, outside of Hyprform's service
• Hyprform is not responsible for trainer-user interactions or agreements

13. Termination

By You

• You may terminate your account at any time through your account settings, available deletion flows in the mobile app (when offered), or by contacting support@hyprformai.com
• Termination does not relieve you of payment obligations
• Trainers may deactivate their public profile without terminating their account

By Us

• We may suspend or terminate accounts for Terms violations
• We may terminate accounts for extended inactivity (3+ years)
• We may deactivate trainer profiles that violate professional standards or Terms
• We will provide notice when possible, unless immediate action is required

14. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.

Arbitration

Any disputes will be resolved through binding arbitration rather than court proceedings, except for small claims court matters.

15. Changes to Terms

• We may modify these Terms from time to time
• We will provide notice of material changes
• Continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your account

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hyprform regarding the Service.

19. Gym-Specific Terms

These terms apply if you register for or use a Gym Account or the Gym Portal.

Gym Account Use

• Gym accounts are intended for facility owners, head coaches, or authorized programming staff managing group class programming
• You are responsible for ensuring uploaded programming documents, WOD history, and generated class plans are accurate and appropriate for your members and coaching staff
• You represent that you have the right to upload and use any documents or programming content you provide

AI-Generated Class Programming

• Generated Rx, Scaled, and Foundations weeks are produced by AI based on your inputs and uploaded history
• You are responsible for reviewing all generated programming before use with members or coaches
• Hyprform does not provide medical advice; ensure programming is appropriate for your members and facility standards

Gym Portal Availability

• The Gym Portal is currently available through our website; mobile app access may be limited for gym-only accounts
• Gym billing, quotas, and feature availability may differ from athlete or trainer accounts and will be disclosed in the product
